1 | Introduction

These General Terms and Conditions govern your use of our services. By using our website and/ or associated products or services, you agree to these terms. If you do not agree with these terms, please do not use our services.

As an entity of the University of Leeds the terms and conditions of the University apply, they can be found at this link.

2 | Definitions

  • Website: Refers to the Professional Academy for Creative Enterprise (PACE) and all related domains and subdomains.
  • User/You/Client: Refers to any individual or entity accessing or using the website and services.
  • Service Provider/We/Us/Our: Refers to the PACE.
  • Content: Refers to all text, images, videos, and other materials made available on the website.
  • Consultancy Services: Refers to expert advice and consultation provided by our academics, experts and/or professionals.
  • Online Learning Services: Refers to courses, webinars, tutorials, and educational resources available through the website, learning management platform or any other platform or method supplied.
  • Onsite courses: Refers to courses, tutorials, training and educational programs delivered onsite either at the University of Leeds, or at another specific location.
  • Production Services: Refers to creative production of visual assets or content creation through different media.
User Eligibility
  • If you are registering on behalf of an organisation, you confirm that you have the authority to act on behalf of that organization.
  • Users must ensure that all provided information is accurate, complete, and up to date.
Account Registration and Security
  • To access certain services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account login information.
  • You agree to notify us immediately of any unauthorized use of your account.
Online Learning Services
  • Course Access: Upon payment, you will receive access to online courses and materials. Access may be limited to a specific duration.
  • Copyright: All course materials are protected by intellectual property laws. Users are not permitted to share, reproduce, or redistribute materials without prior written permission.
  • Course Completion: Completion certificates may be issued upon fulfilling the course requirements. The issuance of certificates is at our discretion.
  • All content is subject to change without notice.
  • Every reasonable effort has been made to ensure the accuracy of the information and currency of information and documentation published. However, content is regularly reviewed and are subject to change from time to time.
  • We recommend that you contact the University to check the current position on courses and services.

Onsite Courses
  • Every reasonable effort has been made to ensure the accuracy of the information and currency of documentation published or used in onsite courses. However, the educational and associated support services are regularly reviewed and are subject to change from time to time.
  • Content may differ to what is advertised depending on need, updates, tutor availability etc.
  • Tutors may differ from those advertised.
  • Courses may be removed from our offer at any time without notice.
  • Refunds are offered in line with our refund policy.
  • Courses may be cancelled by PACE at short notice due to unforeseen circumstances, in this case alternate dates will be offered.
  • There may be filming and photography happening during onsite courses, of the courses themselves or in and around the location of them. If you do not wish to be captured in any image or video content, please make a member of staff aware. There will be notices around the location if this is happening.
  • It is the sole responsibility of the course attendee to arrange transportation to and from the location of the course, training or seminar.

Consultancy and Production Services
  • Consultancy and Production Services are managed on a case-by-case basis and will be covered through individual contracts.
  • NDA's may be required prior to commencing any contract.
Payments and Fees
  • All prices for courses, consultancy and production services that are listed on the website and are subject to change without notice.
  • Payments must be made in advance for online and onsite courses using the available payment methods.
  • Payments for Production and Consultancy services will be made via invoice unless otherwise agreed.
  • Refunds are only available under specific conditions outlined in our Refund Policy.
Refund Policy
  • Refunds for online courses are only available within 24 hours after purchase, provided no more than 1 lesson of any course has been accessed.
  • No refunds are offered for onsite courses if you fail to attend or do attend the course.
  • Refunds for onsite courses are available up to 4 weeks prior to the start date of the course at 100% of the course cost. 50% of the course cost will be refunded up to 2 weeks prior to the start date. Within 2 weeks of the course start date no refunds are offered.
  • Refunds for consultancy and production are managed via their specific contracts.
User Conduct
  • You agree not to use the website or services for any unlawful purpose or in any way that disrupts the functionality of the platform.
  • You must not attempt to gain unauthorized access to the website, servers, or data.
  • Offensive or inappropriate behaviour in communication with consultants, instructors, or other users will result in immediate termination of your account.
Intellectual Property
  • All content, including course materials, videos, and branding on the website, online learning platforms and onsite materials is the intellectual property of PACE unless otherwise stated.
  • You may not reproduce, distribute, or create derivative works from any content without our express written consent.
Disclaimers
  • We do not guarantee that the website will be available at all times or that it will be error-free.
  • Online and onsite courses, consultancy and production services are provided "as is" without warranties of any kind, either express or implied.
  • We do not warrant that the learning, consultancy or production services will meet your specific requirements or that the results from the services will be accurate, reliable, or free from errors.
  • This website is not intended to form part of the contract between the University or PACE and its students, customers, research or business partners.
Limitation of Liability
  • To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the website or products and services.
  • In jurisdictions where limitations of liability are not allowed, our liability is limited to the maximum extent permitted by law.
Termination
  • We reserve the right to suspend or terminate your access to the website and services at any time without notice for violation of these terms.
  • Upon termination, your right to use the services will immediately cease, and any fees paid are non-refundable.
Changes to Terms
  • We may update these terms from time to time without prior notice. Continued use of the website after changes are made constitutes acceptance of the updated terms.
Privacy
  • Our collection and use of personal data are governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as outlined in the Privacy Policy.
